Terms of service

You are responsible for the accuracy of your account details, for the security of your credentials, and for what the people you invite into your workspace do with it. Tell us promptly if you believe an account has been compromised.

Mercury is built for legitimate business outreach. You agree that you will not use it to:

• Contact people whose details you obtained unlawfully, or who have opted out
• Send content that is deceptive, fraudulent, harassing, or unlawful
• Misrepresent who you are or who you represent, including instructing an AI agent to deny being an AI
• Clone the voice of anyone who has not personally consented to it
• Circumvent the contact limits, suppression lists, or unsubscribe mechanisms in the product

We may suspend a workspace that breaches these rules, and we will do so without notice where continued use would cause harm.

You choose your prospects, your message, and your jurisdictions. Marketing and calling laws vary and change; complying with the ones that apply to you is your responsibility. Mercury provides controls — suppression, contact limits, unsubscribe headers, call records — to make compliance practical, but using them is up to you.

You keep ownership of the data you bring: your leads, your content, your voice profiles. You grant us only the permission needed to run the service for you. We keep ownership of the software.

We aim to keep Mercury running and will give reasonable notice of planned maintenance, but the service is provided as-is without a guarantee of uninterrupted availability. Third parties we depend on — mail providers, telephony carriers — can fail in ways we do not control.

You can close your account at any time. We can end the agreement for material breach of these terms. On termination you can export your data during a short grace period, after which workspace data is deleted.
